Protection for Vulnerable Individuals

A Person in Need of Protection is someone currently in Canada who would face serious risks if returned to their home country. Claiming Refugee Status

Port of Entry (POE) Claims

If you arrive in Canada and need to claim refugee status, you can do so at a Port of Entry. This includes airports, seaports, or border crossings. Here’s how it works:

  • Initial Claim: At the POE, you will meet with a Canada Border Services Agency (CBSA) officer who will assess your claim’s eligibility.
  • Simple Process: There’s no need to visit an inland immigration office for your initial claim. The process is streamlined to ensure your safety and swift action upon arrival.

Inland Claims

For those already in Canada, Inland Claims can be made at any Immigration, Refugees and Citizenship Canada (IRCC) office. Here’s what to expect:

  • Appointment Scheduling: You’ll need to book an appointment, typically available within two weeks of your request.
  • Eligibility Interview: During your appointment, an officer will conduct an interview to assess your eligibility for refugee protection. If successful, your case will be referred to the Immigration and Refugee Board (IRB).

Note: Inland claims are generally processed in larger cities like Toronto, Montreal, and Vancouver, where IRB offices are located.

The Basis of Claim Form

Completing the Basis of Claim (BOC) Form is a critical step in your refugee claim process. This document is essential for the Immigration and Refugee Board to determine the validity of your claim. Here’s what you need to know:

  • Careful Completion: It’s vital to fill out the BOC Form accurately and thoroughly. Incomplete or inconsistent information can lead to a denial of your claim.
  • Key Information: The form requires details about your identity, family, supporting documents, travel history, and the reasons for your refugee claim.

The BOC Form serves as your voice to the Refugee Protection Division (RPD), helping to present your case for protection in Canada.
